Mental Capacity Act

The Mental Capacity Act is a legal framework to support people over the age of 18 to make their own choices.
 We assume people can make their own decisions, unless we become aware that they do not have mental capacity.
Adults should be assisted as much as possible to make their own choices, but where they are unable to do so, acts or decisions should be made in a person’s best interest.
We often need to work with customers alongside partner agencies so customers who lack capacity are supported to receive the right help and to ensure the right decisions are made.
